McClain Bank Online Banking Agreement

 
This Online Banking Agreement (the "Online Agreement") for accessing your accounts via McClain Bank Online explains the terms and conditions governing the following online services: account access, and other services offered through McClain Bank Online (collectively, the "Online Financial Services"). By using the Online Financial Services you agree to abide by the terms and conditions of this Online Agreement. This Online Agreement will be governed by and interpreted in accordance with all applicable federal laws and regulations and the laws of the state of Oklahoma. Your use of McClain Bank Online may also be affected by the agreements between us for your deposit, credit card, and other linked accounts. When you link accounts to McClain Bank Online, this does not change the agreements you already have with us on those accounts. For example, when you use McClain Bank Online to access a credit account, you do so under the terms and conditions we gave you in the agreement and disclosure for the credit account. You should review those agreements for any applicable fees, for limitations on the number of transfers you can make, and for other restrictions which might impact your use of an account with McClain Bank Online. The following rules will apply to the extent there is no applicable federal law or regulation. The terms "we," "us," "our," and "Bank" refer to McClain Bank, or one of its affiliates. "You" refers to each signer on an account. The term "business day" shall mean every day except Saturdays, Sundays and federal banking holidays.
 

 

FAQs

Through McClain Bank Online, you must have an eligible account (listed below) and an online Personal Identification Number (PIN). In addition, you must have the required software. Online Banking works best in the latest version of one of these browsers: Chrome, Firefox, Microsoft Edge, or Safari. Microsoft Internet Explorer versions 10 and older are not supported.

You will be given a PIN number that will give you access to your accounts through McClain Bank Online. McClain Bank Online will prompt you to change your PIN the first time you log on. If you forget your PIN, you may notify McClain Bank. We recommend that you change your PIN regularly. The Bank is entitled to act on instructions received under your PIN. For security purposes, it is recommended that you memorize this online PIN and do not write it down. You are responsible for keeping your PIN and account data confidential.

All McClain Bank deposit accounts and loans are eligible accounts provided you are a signer, co-signer or the owner or co-owner of the account. The account owner is required to approve access for authorized signers.

If you close the eligible account, you must notify Customer Service and identify a new payment account for the selected services. Additionally, if you close all your accounts, you must notify McClain Bank Customer Service to cancel your Online Financial Services. Your Online Financial Services may be canceled at any time without prior notice due to insufficient funds in one of your accounts. After cancellation, Online Financial Services may be reinstated, once sufficient funds are available in your accounts, to cover any fees and other pending transfers or debits. In order to reinstate your services, you must call McClain Bank Customer Service at (405) 527-6503. If you do not access your accounts via McClain Bank Online for any three-month period, we reserve the right to disconnect your service. You agree to be responsible for any online service provider and telephone charges, which you incur by accessing your accounts through McClain Bank Online. If you wish to cancel any of your Online Financial Services offered through McClain Bank Online, please contact McClain Bank Customer Service at (405) 527-6503 or send cancellation instructions in writing to McClain Bank, P.O. Box 351, Purcell, Oklahoma 73080.

There are no monthly or transaction fees for accessing your personal account(s) through McClain Bank Online. Other fees, as described in the deposit account information, may apply to services ordered online and to transfers to and from your accounts. Please note that fees may be assessed and billed separately by your online service provider and are not included in McClain Bank Online.

You should note that on accessing McClain Bank Online, you may incur charges for: normal account fees and service charges, any Internet service provider fees, payments or transfers made through McClain Bank Online from a savings account may result in an excess transaction fee. See your savings or money market account for details. Additionally, fees may be assessed for added features of McClain Bank Online such as check and statement copy orders, and non-sufficient funds. Please consult your deposit account information to see if your accounts qualify for these fees.

You can obtain balance and transaction history on all eligible accounts that are enrolled in McClain Bank Online. Account balance and transaction history reflects activity through the close of the previous business day.

You may also be able to transfer funds from one eligible account to another. The number of transfers from accounts may be limited as described in the applicable portions of the deposit account information. If a "hold" has been placed on deposits made to an account from which you wish to transfer funds, you cannot transfer the portion of the funds held until the "hold" has been released.

You can access your accounts through McClain Bank Online seven days a week, 24 hours a day. However, at certain times, some or all of McClain Bank Online may not be available due to system maintenance. A transfer initiated through McClain Bank Online before 7:55 PM (Central Time) on a business day is posted to your account the same day. All transfers completed after 7:55 PM (Central Time) on a business day or on a Saturday, Sunday or banking holiday, will be posted on the next business day. Our business days are Monday through Friday, except for banking holidays. "Banking holidays" shall mean all federal banking holidays.

McClain Bank Online also allows you to do research into past transactions on your account, view check images and print past statements.

McClain Bank may, from time to time, introduce new Online Financial Services. We shall update this Online Agreement to notify you of the existence of these new services. By using these services when they become available, you agree to be bound by the terms contained in this Online Agreement. Notification of new services may also be shown in the remarks section on the first page of the McClain Bank Online screen or we will notify you via email if you provide us with your email address.

In case of questions or errors about online funds transfers through McClain Bank Online involving a Bank account, you should do one of the following: Contact McClain Bank at (405) 527-6503, between the hours of 8:00 AM and 6:00 PM Monday - Friday, 8:00 AM and 12:00 PM on Saturdays, except for banking holidays. "Banking holidays" shall mean all federal banking holidays. Write to McClain Bank, P.O. Box 351, Purcell, OK 73080, as soon as you identify any errors or discrepancies in your statement or transaction record, or if you need more information about a transaction listed on the statement or transaction record. You must notify McClain Bank no later than sixty (60) days after we have sent the first paper or online statement on which the problem or error appeared. If you notify us verbally, we may require that you send us your complaint or question in writing within ten (10) business days. When you notify us about the problem, please: tell us your name and account number; describe the error or the transaction you are unsure about and explain why you believe it is in error or what additional information you need; tell us the dollar amount of any suspected error. If we do not complete a transfer to or from your Bank account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable: if, through no fault of ours, you do not have enough money in your account to make a transfer; if a legal order directs us to prohibit withdrawals from the account; if your account is closed or if it has been frozen; if the transfer would cause your balance to go over the credit limit for any credit arrangement set up to cover overdrafts; if you, or anyone you allow, commits any fraud or violates any law or regulation; if any electronic terminal, telecommunication device or any part of the electronic fund transfer system is not working properly; if you have not properly followed the instructions for using McClain Bank Online; if circumstances beyond our control (such as fire, flood or improper transmission or handling of payments by a third party) prevent the transfer, despite reasonable precautions taken by us.
The Bill Pay Service ("Bill Pay") allows you to schedule bill payments through McClain Bank Online. Therefore, you must have an eligible account enrolled in McClain Bank Online in order to participate in Bill Pay.
You can arrange, at your option, for the payment of your current, future and recurring bills from one or more of your McClain Bank checking accounts. There is no limit to the number of payments that may be authorized. You may pay any merchant or individual approved by McClain Bank for payment through the Bill Pay Service. By furnishing us with the names of your payees/merchants and their addresses, you authorize us to follow the payment instructions to these payees/merchants that you provide us via McClain Bank Online. When we receive a payment instruction (for the current or a future date), we will remit funds to the payee on your behalf, from the funds in your selected account, on the day you have instructed them to be sent ("Payment Date"). However, we shall not be obligated to make any such payment unless your account and/or overdraft protection plan has sufficient funds or credit availability to pay the bill on the Payment Date. Funds for ALL electronic bill payments will be withdrawn from your account ON THE DAY the payment is scheduled TO BE SENT TO THE PAYEE. Payments made by Check will be sent on the day the payment is scheduled TO BE SENT TO THE PAYEE and will clear your account the same as if you wrote the check yourself. You have the right to stop or change any scheduled payment. You must cancel the payment by no later than 11:00 AM (Central Time), on the Payment Date, by using the DELETE function on the View Scheduled Payments page.
Any payments made with Bill Pay require sufficient time for your payee to credit your account properly. To avoid incurring a finance charge or other charge, you must schedule a payment sufficiently in advance of the due date of your payment. When you schedule payments: YOU MUST SCHEDULE CHECK PAYMENTS AT LEAST 5 FULL BUSINESS DAYS PRIOR TO THE DATE THE PAYMENT IS DUE AT YOUR PAYEE. YOU MUST SCHEDULE ELECTRONIC PAYMENTS AT LEAST 2 FULL BUSINESS DAYS PRIOR TO THE DATE THE PAYMENT IS DUE AT YOUR PAYEE. We shall not be responsible for any charges imposed or any other action taken by a payee resulting from a payment that you have not scheduled properly, including any applicable finance charges and late fees. In addition, we will not be liable if any third party through whom any bill payment is made fails to properly transmit the payment to the intended payee. We will also not be liable if there are insufficient funds or credit availability in your designated payment account and/or overdraft protection plan; if a legal order directs us to prohibit withdrawals from the payment account; if the payment account is closed or frozen; or if any part of the electronic funds transfer system is not working properly. We will not be liable for indirect, special, or consequential damages arising out of the use of Bill Pay.
There is not set up fee for activation of the Bill Payment feature of McClain Bank Online. There is also no monthly service charge incurred for this service, however, as with any manual transaction, insufficient fees and stop payment fees apply. In addition, you should note that by accessing McClain Bank Online Bill Pay, you may incur charges for: normal account fees and service charges, any Internet service provider fees, payments or transfers made through McClain Bank Online from a savings account may result in an excess transaction fee. See your savings or money market account for details. Additionally, fees may be assessed for added features of McClain Bank Online such as check and statement copy orders, and non-sufficient funds. McClain Bank Online General Terms and Conditions

 

The first time you access any of your accounts through McClain Bank Online confirms your agreement to be bound by all the terms and conditions of this Online Agreement and acknowledges your receipt and understanding of this disclosure.

Our Liability - Except as specifically provided in this Online Agreement or where the law requires a different standard, you agree that neither we nor the service providers shall be responsible for any loss, property damage or bodily injury, any indirect, special, incidental or consequential damages whether caused by the equipment, software, the Bank, OR by Internet browser providers OR by Internet access providers OR by online service providers OR by an agent or subcontractor of any of the foregoing, nor shall we or the service providers be responsible for any direct, indirect, special or consequential, economic or other damages arising in any way out of the installation, use or maintenance of the equipment, software, the Online Financial Services, or Internet browser or access software.

Changes to Charges, Fees or Other Terms - McClain Bank reserves the right to change the charges, fees or other terms described in this Online Agreement. When changes are made to any fees, charges, or other material terms, we will update this Online Agreement and either send a notice to you at the address shown on our records or send you an electronic mail message (email). The notice will be posted or sent at least thirty (30) days in advance of the effective date of any additional fees for online transactions, or of any stricter limits on the type, amount or frequency of transactions or any increase in your responsibility for unauthorized transactions, unless an immediate change is necessary to maintain the security of the system. If such a change is made, and it can be disclosed without jeopardizing the security of the system, we will provide you with electronic or written notice within thirty (30) days after the change. You may choose to accept or decline changes by continuing or discontinuing the accounts or services to which these changes relate. We also reserve the option, in our business judgment, to waive, reduce or reverse charges or fees in individual situations. Changes to fees applicable to specific accounts are governed by the applicable Depositor Contract and the deposit account information.

Disclosure of Account Information - You authorize the Bank and each of its affiliates to disclose to third parties, agents, and affiliates, such as independent auditors, consultants or attorneys, information you have provided or that we or our affiliates have obtained about your accounts and the transfers you make: to comply with government agencies or court orders or requests; or to verify the existence and condition of your account for a third party, such as a credit bureau or merchant; or where it is necessary for completing transfers; or to provide services relating to your account; or if you give us your further written permission.

Other General Terms/Other Agreements - In addition to this Online Agreement you agree to be bound by and will comply with the requirements of the applicable portions of the deposit account information, prospectuses for any mutual funds, the Bank's rules and regulations, the rules and regulations of any funds transfer system to which the Bank belongs, and applicable state and federal laws and regulations. We agree to be bound by them also.

Bank's Right to Terminate this Agreement -The Bank reserves the right to terminate this Online Agreement and your access to Online Financial Services through McClain Bank Online, in whole or in part, at any time.

No Third Party Access - You further agree to not permit any third parties to have access to your account at McClain Bank Online.

Assignment - The Bank may assign this Online Agreement to its parent corporation or to any now-existing or future direct or indirect subsidiary of its parent corporation. The Bank may also assign or delegate certain of its rights and responsibilities under this Online Agreement to independent contractors or other third parties.

 


 
McClain Bank Online Bill Pay General Terms and Conditions
 
McClain Bank reserves the right to terminate your use of Bill Pay at any time. If, for any reason, you should ever wish to cancel McClain Bank Online, we strongly suggest that you cancel all future bill payments at the same time that you cancel your service by deleting those payments yourself using McClain Bank Online. This will ensure that future payments and transfers made by you will not be duplicated. We will continue to maintain your accounts until you notify us otherwise.
